1. Who we are, and what these terms cover

This website, littleawait.com, is operated by Lazurta LLC, a limited liability company registered in the State of Wyoming, United States, trading as Little Await, with its registered address at 30 N Gould St, Sheridan, WY 82801, United States.

In these terms, "we", "us" and "our" mean Lazurta LLC. "You" means you, whether you are browsing the site or buying from it. "Site" means littleawait.com and every page on it. "Products" means the goods we offer for sale.

By visiting this site or placing an order, you agree to these Terms of Service together with our Privacy Policy, Refund Policy and Shipping Policy, each of which is incorporated into these terms by reference. If you do not agree to them, please do not use the site.

If there is a conflict between these terms and the Privacy Policy on any question about personal information, the Privacy Policy governs. If there is a conflict between these terms and the Refund Policy or Shipping Policy on any question about returns or delivery, those policies govern.

2. Eligibility

You must be at least 18 years old, or the age of majority in the place where you live, to place an order. By ordering you confirm that you meet this requirement and that the payment method you are using belongs to you or that you are authorised to use it.

This site is not directed at children and we do not knowingly sell to them.

3. The products

Our products are printed to order. Nothing is held in a warehouse; your item is manufactured after you buy it.

We describe our products as accurately as we can, and the photographs on the site are of the actual product. Even so:

• Colour may vary slightly between your screen and the printed item, and between production runs. Screens are backlit and paper is not, and no two monitors are calibrated identically.
• Paper stock and binding are subject to occasional substitution with an equivalent or better specification, where a print partner's supply changes. We will not substitute anything that changes the character of the product.
• Minor variation is inherent to print. Trim can vary by a millimetre or two and binding alignment is not machine-perfect. We reject anything outside our tolerance before it ships.

We may change our products, their specifications and their prices at any time, and we may discontinue a product without notice. Changes do not affect an order we have already confirmed.

4. Orders, and when a contract is formed

All prices are displayed in US dollars unless your checkout displays a different currency. Prices exclude any sales tax or VAT, which is calculated and shown at checkout where it applies.

Placing an order is an offer to buy, not a concluded contract. A contract is formed only when we send you an order confirmation email. Until then we may decline your order for any lawful reason, including:

• the product is unavailable or has been discontinued;
• we cannot ship to the address you provided;
• we suspect fraud or an unauthorised payment method;
• the order appears to be for commercial resale, where we have not agreed to that; or
• the product was listed at a materially incorrect price because of an error.

If we decline an order after taking payment, we refund you in full, promptly, without you needing to ask.

Pricing errors. If a product is listed at an obviously incorrect price — a decimal in the wrong place, for instance — we are not obliged to sell it at that price, even after confirmation. We will contact you, explain, and offer you the choice of paying the correct price or receiving a full refund.

Quantity limits. We may limit the quantity of any product sold to one person, household, or address.

5. Payment

Payment is taken in full at the time of order through our payment processor. We do not see or store your full card number; card data is handled by the processor under its own security standards.

You confirm that the payment information you provide is accurate and that you are authorised to use the payment method. If a payment is reversed, charged back, or fails after dispatch, we may suspend further orders from you until it is resolved.

6. Shipping, returns and refunds

Where we ship, how long it takes, and what it costs are set out in our Shipping Policy. Returns, refunds, cancellations and the Perfect Gift Promise are set out in our Refund Policy. Both form part of these terms and you should read them before ordering.

Risk in the products passes to you on delivery. Title passes on full payment.

7. Accuracy of the information you give us

You are responsible for the accuracy of the shipping address, email address and any personalisation details you provide, including where you are sending an order to someone else.

We are not liable for a failed or delayed delivery caused by an address you supplied incorrectly, though we will always help you put it right — see Failed or returned deliveries in the Shipping Policy.

8. Your account

If you create an account, you are responsible for keeping your password confidential and for all activity under your account. Tell us immediately if you believe it has been compromised. We may suspend or close an account that we reasonably believe is being used in breach of these terms.

9. Intellectual property

All content on this site — including the Little Await name and logo, product designs, illustrations, layouts, photographs, page copy, and the selection and arrangement of all of it — is owned by Lazurta LLC or used under licence, and is protected by copyright, trade mark and other intellectual property laws.

You may not copy, reproduce, republish, resell, distribute, transmit, or create derivative works from any of it without our prior written permission. You may not use our name, logo or product imagery in any way that suggests an endorsement or association that does not exist.

Buying a product gives you ownership of that physical item. It does not transfer any right in the design printed on it. You may photograph your own product and share it — we would like that — but you may not reproduce the design commercially.

If you believe content on this site infringes your rights, email hello@littleawait.com with a description of the work, where it appears on our site, and your contact details. We will investigate and respond.

10. Reviews and anything you submit to us

If you send us a review, photograph, comment or suggestion, you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce and publish it in connection with our business, including in marketing, with attribution to the first name and initial you provide unless you ask us not to.

You confirm that anything you submit is your own, that it does not infringe anyone else's rights, and that it is not unlawful, misleading, defamatory or obscene. We may edit for length or decline to publish anything, and we may remove published content at any time.

We do not publish invented reviews, and we do not pay for reviews. Every quoted customer word on this site comes from a real customer.

11. Acceptable use

You agree not to use this site:

• for any unlawful purpose, or to solicit anyone else to do anything unlawful;
• to infringe our intellectual property rights or anyone else's;
• to harass, abuse, defame or discriminate against any person or group;
• to submit false or misleading information, or to impersonate anyone;
• to upload or transmit any virus, malware or other malicious code;
• to scrape, harvest, index or copy site content by automated means, or to circumvent any measure we use to prevent that;
• to probe, scan or test the vulnerability of the site or any related system, or to breach any security or authentication measure;
• to interfere with or circumvent any feature of the site, or to place unreasonable load on our infrastructure.

We may terminate your access for breach of this section without notice.

12. Third-party services and links

This site is hosted by Shopify, and we use third-party services for payment processing, printing and fulfilment, email, analytics and advertising. Those providers process data under their own terms and privacy policies; our Privacy Policy explains what we share and why.

Where we link to third-party sites, we do so for convenience. We do not control them, we do not endorse their content, and we are not responsible for their accuracy, their policies, or anything you buy from them. Review their terms before you use them.

13. Accessibility

We want this site to be usable by everyone. If you encounter a barrier that prevents you from browsing or ordering, email hello@littleawait.com and tell us what happened. We will fix what we can, and in the meantime we will take your order by email.

14. Electronic communications

You consent to receive communications from us electronically, and you agree that any notice, agreement, disclosure or other communication we send you electronically satisfies any legal requirement that it be in writing.

Transactional emails about your order are not marketing and cannot be unsubscribed from while an order is in progress. Marketing emails always carry an unsubscribe link, and we act on it immediately.

15. Disclaimer of warranties

Except as expressly stated in these terms, in our Refund Policy, or as required by law, this site and our products are provided "as is" and "as available", without warranties or conditions of any kind, whether express or implied, including any implied warranty of merchantability, satisfactory quality, fitness for a particular purpose, or non-infringement.

We do not warrant that the site will be uninterrupted, secure, error-free, or free of harmful components, or that any defect will be corrected.

This section does not apply where the law does not allow it. In particular, it does not affect the statutory guarantees you have as a consumer — including under the UK Consumer Rights Act 2015 and the Australian Consumer Law — which cannot be excluded.

16. Limitation of liability

To the fullest extent permitted by law, our total aggregate liability to you for any claim arising out of or in connection with your use of this site or your purchase of a product is limited to the amount you actually paid for the product giving rise to the claim.

We are not liable for indirect, incidental, special, consequential, exemplary or punitive losses, including loss of profit, loss of revenue, loss of data, loss of goodwill, or loss of opportunity, however arising.

Nothing in these terms excludes or limits our liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; any breach of the statutory rights described in our Refund Policy; or any other liability that cannot lawfully be excluded or limited.

If you are a consumer, your statutory rights are unaffected by this section.

17. Indemnity

You agree to indemnify and hold harmless Lazurta LLC, its members, officers, employees, agents and suppliers against any claim, demand, loss or expense, including reasonable legal fees, arising out of your breach of these terms or your unlawful use of the site.

18. Force majeure

We are not liable for any failure or delay in performing our obligations where that failure or delay results from something beyond our reasonable control, including natural disaster, severe weather, fire, flood, epidemic, war, civil unrest, strike or industrial action, carrier failure, failure of a print partner, power or telecommunications failure, or government action.

Where such an event materially delays your order, we will tell you, and you may cancel for a full refund.

19. Resolving a dispute

Please email us first. If something has gone wrong, email hello@littleawait.com and give us the chance to fix it. We resolve nearly everything within a business day. We ask you to raise it with us before starting formal proceedings or a chargeback, and we commit to responding substantively within 10 business days.

20. Governing law and jurisdiction

These terms and any dispute arising out of them are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws principles. The state and federal courts located in Sheridan County, Wyoming have jurisdiction.

This does not take away your local consumer rights. If you are a consumer resident in the United Kingdom, the European Economic Area, Canada or Australia, you retain the benefit of any mandatory consumer protection law of your country of residence, and you may bring proceedings in the courts of that country where the law gives you that right.

21. General

Entire agreement. These terms, together with the policies incorporated into them, are the entire agreement between us and supersede any prior understanding.

No waiver. If we do not enforce a provision of these terms, that is not a waiver of our right to enforce it later.

Severability. If any provision is found unlawful or unenforceable, it is severed to the minimum extent necessary and the remainder stays in force.

Assignment. You may not assign or transfer your rights under these terms. We may assign ours, including in connection with a merger, acquisition or sale of assets, without affecting your rights.

Headings. Section headings are for convenience and do not affect interpretation.

22. Changes to these terms

We may update these terms at any time by posting a revised version on this page and updating the "Last updated" date above. The version published at the moment you place an order is the version that governs that order. Continuing to use the site after a change means you accept the revised terms.
